As the SEC Continues Its Crypto Litigation Retreat, Heres Whats Still Outstanding
The SEC is dropping several lawsuits and investigations against crypto companies. Lawsuits against Ripple, Kraken, Cumberland DRW, and Pulsechain are still ongoing. Investigations into Unicoin, Crypto.com, and Immutable are also still open. The SEC has dropped cases against Coinbase and ConsenSys and paused cases against Binance and Tron. Investigations into Robinhood Crypto, Uniswap, OpenSea, and Gemini have been closed. The Kraken case involves allegations of operating as an unregistered securities broker. The Cumberland DRW case involves allegations of operating as an unregistered securities dealer. The Ripple case, focusing on XRP, is under appeal after a judge ruled XRP wasn't a security when sold to retail investors. The Pulsechain case involves fraud and registration allegations. Crypto.com previously sued the SEC but dropped the suit. Immutable received a Wells notice related to its IMX token. Unicoin received a Wells notice regarding potential fraud and unregistered securities sales. The SEC appears to be shifting away from "regulation by enforcement" and towards creating clearer regulations for the crypto industry.
